Fairway Divorce Solutions® offices are owned and operated either by FDS or an affiliate of FDS or by independent franchisees. FDS, an Alberta Canada corporation, licenses independent franchisees to provide Fairway Divorce Solutions® products and services to the public. This Site is presented by FDS. Fairway Divorce Solutions® assumes no responsibility or liability for the privacy practices of our franchisees in their handling of your personal information they collect from you online or offline.
Personal Information is defined as “information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization.” In other words, it is information particular to an individual that would allow him or her to be identified. This would include your name, residential address, e-mail address(es), telephone number, and personal financial information. We also collect information concerning when a client engaged a Franchise Divorce Solutions® office (corporate or franchised), the manner and amount of the client’s retainer, when a client file was opened and closed, and certain other information that will allow our network of franchisees and our corporately-owned offices to improve our systems and delivery.
FDS and its affiliates and franchisees collect personal information in order to facilitate the services that are offered through our network of franchisees and our corporately-owned offices to our respective clients. FDS also collects Personal Information about its franchisees, for example, to determine their credit-worthiness or for the preparation and/or registration of documents needed to grant a franchise to an individual. FDS, its affiliated corporations and its franchisees may put Personal Information to a variety of uses, which may include invoicing client accounts as appropriate; communicating information and offers to clients; to better understand, analyze, and respond to our clients’ needs and preferences, and to subsequently develop, enhance, and/or provide products and services to meet those needs.
We try to ensure that you understand how FDS and its affiliates and franchisees use your Personal Information. One of the ways this is done is by obtaining your consent. Consent may be either express or implied. Express consent is given when we specifically ask you if it acceptable to you that we gather certain information and you explicitly agree that it is. Implied consent occurs when you provide information that may be Personal Information without objection. As we obtain only the information necessary to assist you with the transaction you require, we operate under the understanding that you have agreed to provide us with this Personal Information voluntarily and with knowledge of this Policy whenever you do so.

It may be combined with other Personal Information collected by FDS, its affiliates or franchisees to provide aggregate statistical information about clients’ service usage preferences, but at no time will your Personal Information be shared with any other parties that might be involved in this aggregate collection of Information
All information submitted to FDS on our franchise inquiry form is used only to assist in the screening of potential franchisees and will be kept confidential.
On the franchise inquiry form, we will collect your name, address, email address, other contact information, and certain financial information and qualifications information that you must enter on the form. By submitting this information, you agree that FDS may retain and use the information to respond to your inquiry and to help us improve our franchise marketing efforts. Information on your online form will become part of any application for a Fairway Divorce Solutions® franchise that you might later submit. We may disclose your personal information to our business units, agents, affiliates and to other third parties as part of our consideration of any subsequent franchise application. We do not authorize unaffiliated third parties to use your personal information for any purpose other than consideration of your application.
FDS, its affiliates or franchisees will advise you on request about what Personal Information about you that we have collected, as well as how it has or will be used. If you provide a written request for this information, we will provide it to you within a reasonable time following confirmation of your identity and may charge a reasonable cost (e.g. photocopying, mail charges) to the individual making the request. We will inform you whether or not we hold Personal Information about you and, when possible, the source of the Information, its use, and any parties to whom it may have been disclosed. You may be required to provide sufficient proof of your identity at this time to ensure the safety and security of the Information we hold and that it is provided to individuals in accordance with this Policy. FDS, its affiliates or franchisees reserve the right to decline to provide access to Personal Information where the information requested would disclose: Personal Information of another individual or of a deceased individual; is not readily retrievable and the burden or cost of providing would be disproportionate to the nature or value of the information; does not exist, is not held, or cannot be found by RCGA; could reasonably result in serious emotional harm to the individual or another individual, or serious bodily harm to another individual; or may harm or interfere with law enforcement activities and other investigative or regulatory functions of a body authorized by statute to perform such functions. FDS, its affiliates or franchisees will not respond to repetitious or vexatious requests for access.
FDS operates secure data networks protected by industry standard firewall and password protected systems and maintains physical, electronic and procedural safeguards to guard the integrity and privacy of these servers and of your Personal Information. Although we can’t guarantee that there will never be a security problem, we and our agents that have access to your information carefully guard against the loss, misuse or alteration of the information we collect on our Site.
