Adult Interdependent Partnership (AIP)

In Alberta, when two people live together in an unmarried relationship they are referred to as Adult Interdependent Partners (AIP) of one another. To be in an AIP, two people must live together in a relationship of independence for either a continuous period of not less than three years or a period of some permanence, if there is a child of the relationship by birth or adoption.

When two people are living together, it is important that everyone has a clear understanding of the expectations around money and children. These clear expectations lay the foundation for concise communication throughout a relationship. Fairway provides couples with the ease of mind when entering into an AIP by providing a comprehensive Adult Interdependent Partnership Plan. The AIP plan lays out the financial, support and parenting implications and boundaries so both people have a clear understanding of their future together. Our Negotiators are trained to ask the difficult questions in a non-threatening way to ensure that all your bases are covered. Start your relationship on a positive note with an AIP Plan.

An AIP has many of the same legal rights as a married couple, so creating a plan prior to or during the relationship will prepare your estate in the event of separation or even death.

Cohabitation Agreements

Cohabitation is a living arrangement in which an unmarried couple lives together in a long-term relationship that resembles a marriage. A cohabitation agreement is a legally binding agreement that sets out important aspects of the relationship. It can address areas such as how you will divide expenses, own property, whether you will maintain joint or separate bank accounts and how your assets will be distributed if one partner dies or leaves the relationship. It may also set out parenting in the case where there are children involved.

Fairway Divorce Solutions® Negotiators are trained to handle these conversations so that you can lay the foundation for a great future versus injecting unnecessary stress and conflict in your relationship. A cohabitation agreement prepared by Fairway will give you the relief you want when entering this next phase of your life together.

Prenuptial Agreements

A prenuptial agreement is a legally binding agreement created by two people before marriage. In the prenuptial agreement you will address such issues as the property brought into the marriage (through a disclosure process) by each person and what the property rights of each will be should a divorce take place.

Given the sensitivity and risk of these conversations, Fairway Negotiators take great care to ensure that they help lay the foundation for a positive future. While some think of prenuptials as only "protecting" the person with pre-marriage assets, we at Fairway like to think of the other issues as well. These issues include protecting you in case of death, disability and divorce, capturing what a fair outcome would be in advance of such an event and leaving everyone feeling more secure and protected.
